Waste Management Regulations for Northern Ireland

Waste Management Licensing Regulations (Northern Ireland) 2003 The Waste Management Licensing Regulations (Northern Ireland) 2003 came into operation on 19th December 2003. The main impact of this will be the transfer of responsibility for waste management licensing from district councils to the Department of the Environment.

The Environment and Heritage Service (EHS) will implement these regulations. EHS will issue licenses, set conditions on licensed activities and monitor sites to ensure compliance with license conditions. The determination of any outstanding applications to district councils for new licenses or variations will fall to EHS.

The introduction of the above regulations provides identical technical competence conditions for Northern Ireland as currently exists in England, Scotland and Wales.

'Table 1' of the Regulations, identifies the facility types that fall to Waste Management Licensing which provide treatment, transfer or disposal of wastes categorised as Hazardous, Non-Hazardous or Inert waste.

'Table 2' of the Regulations stipulates the particular WAMITAB Certificate of Technical Competence required to be held by the 'Technically Competent Person', unless an exemption applies. The COTC awards specified in 'Table 2' are identical to those required by the equivalent Waste Management Licensing Regulations in force in England, Wales and Scotland.
